Nomorepass SL (hereinafter «Nomorepass»), residing in c / Parque Bujaruelo, 37, 1c 28924 Alcorcón, in order to know the preferences of users of the application nomorepass (hereinafter «the app») has decided to implement a promotion (hereinafter the «PROMOTION»), which will be developed in accordance with the provisions of these rules.
This promotion is free and does not involve any cost for participants. It is aimed at those people who register in the draw form and access the promotion.
Temporal and territorial scope of the promotion
The promotion is carried out within the Spanish State and its duration is between 22/12/2020 and 04/01/2021 (both included). Participation closes on 03/01/2021 at 12:00 pm Spanish peninsular time
Legitimation to participate.
All those individuals over 18 years of age who are residents in Spain during the promotional period and in accordance with the procedure established in these rules may participate in the promotion.
Each person, regardless of the number of applications they make, will only be eligible for a single prize provided they meet the established requirements.
Staff employed by Nomorepass SL or companies involved in carrying out the promotion or companies that have a business relationship of agency or service provision with any of them, as well as their direct relatives up to second degree of consanguinity or affinity, may not participate in the promotion.
In the event that any of the persons excluded from participation should be the winner, they will lose their right to obtain the prize, and the prize will be awarded to the corresponding substitute, in order of election, who meets the valid participation conditions.
The winner of the promotion must provide his or her nomorepass device ID to prove that he or she had the app installed prior to completing the survey. The user can also provide as proof the evaluation in the store with the corresponding email of the winner with a date prior to the survey.
The promotion will be carried out through a contact form hosted in Google Docs. Each participant must fill in their data, fill in the survey and rate the app in the app store from which the app was installed.
Winners and awards ceremony.
The prize will be awarded if at the time of the closing of the promotion more than 500 surveys have been collected and correctly filled in.
One winner and two substitutes will be chosen via the Sweepstakes2 page on January 4, 2021 in the morning.
The winners will be contacted via email to ensure their eligibility for the prize and, if so, to provide Nomorepass with the necessary data to send the prize. They will have a period of 2 working days to demonstrate their eligibility and express their acceptance of the prize.
The prize is not redeemable for its cash amount.
In case of force majeure, Nomorepass reserves the right to replace the prize with another of similar characteristics, of equal or greater value than those provided.
The winners will be published on the website nomorepass.com once all the winners have been confirmed.
Communication to the winners.
The winner will be informed as indicated in point 4.6
In the event that Nomorepass does not receive the communication of acceptance of the prize within the time limit specified above, it will be understood that the winner renounces it, passing it to the corresponding substitute winner. Likewise, in the event that the total number of substitutes is exhausted, the prize may be declared void and will remain in the hands of Nomorepass.
The winners may waive the prize, but in no case may they exchange it for another different one or for its cash amount.
Reservations and limitations.
Nomorepass and the companies involved in carrying out the promotion are exonerated from any responsibility in case of malfunction of the site or electronic communication networks, which prevent the normal development of the promotion for reasons beyond their control and especially for external acts of bad faith..
Neither will they be responsible for problems of transmission or loss of data not attributable to them.
Nomorepass is not responsible for any loss, damage, delay or any other circumstance attributable to third parties that may affect participation in this promotion, as well as the services that may be provided by third parties with respect to the enjoyment of the prizes.
Nomorepass and the companies involved in carrying out the promotion are exempt from any liability in the event that there is an error in the data provided by the participants themselves that prevents their identification.
Nomorepass reserves the right to make changes that result in the success of the promotion when there is a just cause or reasons of force majeure that prevent it from carrying out the promotion in the manner described in these rules.
Nomorepass reserves the right to cancel the participation of any user who considers it to be misusing the service, which is understood to mean misuse (among others):
Failure to comply with the rules of this document.
Prevent the normal use of the draw by other users, including spam or troll actions.
Image rights.
The winner, by the fact of participating, authorizes the organizing companies to reproduce, use and disseminate his/her name, surname and written content or any material provided, in any advertising and/or promotional activity related to this promotion, all in any media (including, but not limited to, exploitation through the Internet and cell phone Internet) without such activities conferring any right of remuneration or benefit except for the delivery of the prize won in accordance with these rules.
All users, whether or not they are winners of the Promotion, agree to grant, free of charge, an authorization in favor of Nomorepass for the use, without any time or territorial limitation, and for any media and modalities and/or forms of its name, or written textual content or materials of any kind that users provide in relation to the development and advertising of the PROMOTION, for the reproduction, making available and public communication, of any material (including photographs, or any other elements or works) that users provide through their participation in the same.
By virtue of the foregoing, participants shall indemnify Nomorepass for the costs, damages or losses arising from (i) any claim made by third parties who claim that any material that participants have delivered or provided in the context of the PROMOTION, infringes their rights, (ii) the breach of any of the guarantees set out in these conditions.
Data protection.
The personal data of the participants will be incorporated into a file under the responsibility of Nomorepass SL, c/ Parque Bujaruelo, 37, 1c 28924 Alcorcón in order to manage the promotion provided that the participant consents to receive this communication, which also implies having read and agreed with the Data Protection statement included in the promotional section in the part reserved for this purpose. In addition, participants may at any time exercise their right of access, rectification, opposition and cancellation by writing to Nomorepass SL at the address above.
Also, for the sole purpose of managing the delivery of the Prize, Nomorepass informs the winners that it will allow access to their personal data to entities responsible for the management and delivery of the same, such as the courier company or the corresponding operator.
Nomorepass will establish the necessary technical and organizational measures to ensure the security that must be gathered by the automated files, treatment centers, premises, equipment, systems, programs and persons involved in the automated processing of personal data in the legal and regulatory manner.
The indication of the personal data of the winners will be obligatory for the management of the Prize. Any false communication of personal data will give the organizers of this PROMOTION the right to disqualify the winner and have the corresponding prize.
Acceptance of rules
Participation in the promotion implies the express and unreserved acceptance of these rules.
Failure to comply with any of these rules by the participant will result in immediate disqualification
Applicable law and arbitration.
These Promotion Rules are governed by Spanish Law.
Any dispute, discrepancy, question or claim resulting from the execution or interpretation of these Rules will be resolved by the Judges and Courts of the City of Madrid, the parties renouncing to the jurisdiction that may correspond.
